KNOW YOUR RIGHTS AGAINST THE POLICE.
*SECTION 36 SUBSECTION (5) OF THE 1999 CONSTITUTION
a. Rights To Fair Hearing And Other Fundamental Rights
b. The Administration Of Criminal Justice Act, 2015
NOTE:
1) You have fundamental rights which are guaranteed under the 1999 Constitution and which are not negotiable.
2) One of these rights is that you are presumed innocent until you are proven guilty.
3) You also have a right to remain silent until you consult with your lawyer or any person of your choice.
4) You have the right to be granted bail within 24 hours in most cases, and if not granted bail, to be charged to court within 48 hours. So, nobody has the right to detain you for unduly long period without been released or charged to court.
5) If you have been arrested or tried once for an offence and convicted and/or pardoned, then you cannot be arrested, tried or convicted for that same offence again.
6) If you don’t insist on your rights, nobody will do so for you. But if you insist, you will eventually have them protected.
7) The Police and other security agents are trained to respect fundamental human rights, but they may threaten, intimidate or harass you into abandoning your rights if you so allow them.
8) The ACJA 2015 is a law made to revolutionize our criminal justice system. It applies to federal offenses in federal courts and in States which have domesticated the law.
