Limitation To Your Right To Fair Hearing
The Constitution provides for a certain exception in the right to fair hearing. It is in relation to the independence of the body before whom the question is asked. Like I pointed out earlier, the rule against independence of a court or tribunal or panel is not breached simply because it was constituted by the same person or authority who is the complainant or against whom the question is asked.
As another example, if a worker in a company is alleged to have offended against the company rules and regulations, the company is entitled to constitute a panel to determine the rights and obligations of the offender, notwithstanding that the company is the complainant, and so long as it meets the requirement under the law that it is not the final authority, allows the person to defend himself and make representations to it.
